1. About these Terms
These Terms of Service ("Terms") are an agreement between you and Houcine Bousfiha (an individual developer based in Morocco, "we", "us"). They govern your use of the PETTO mobile app for iPhone and Android and the services we provide through it (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
Our Privacy Policy explains how we collect and use personal information. Please read it alongside these Terms.
2. What PETTO does
PETTO helps you organize the everyday care of your pets. With the Service you can:
- create a profile for each pet, by filling in a form or by describing your pet in your own words (by typing, speaking or adding a photo) for PETTO's AI features to turn into a profile (see Section 8);
- plan care activities, such as feeding, medication, exercise, grooming and appointments, as one-time or repeating activities;
- receive reminders for those activities on your device, including optional early reminders before an activity;
- add PETTO widgets to your phone's home screen and, on iPhone, its lock screen, to see your pet's day and tick activities off (see Section 9);
- mark activities as done or skipped, snooze or reschedule them, and look back at your pets' care history, where an activity nobody marked is recorded as missed;
- use PETTO without a connection: see your pets and their activities as last loaded on your phone, and mark activities done, skipped or snoozed, which PETTO sends once you're back online (other changes need a connection, and what's shown offline may be out of date);
- add photos of your pets;
- keep a health record for each pet (vaccinations, vet visits, medicines, allergies, conditions, your vet's contact details, its microchip number and whether it's spayed or neutered), with reminders added for the dates ahead in it;
- upload your pet's vet documents when you add it, or later from its health record, for PETTO's AI features to read into its health record and profile (see Section 8);
- export a pet's health record as a PDF, to save or share; and
- chat with the PETTO assistant about each pet's health, food, behaviour and care, by typing, speaking or sending photos, and add the care activities and health record entries it suggests (see Section 8).
The Service is available in English, French and Arabic.
Features shown in the app as previews, samples or "coming soon" are not part of the Service until we make them available, and these Terms do not promise that we will.
3. PETTO is not a veterinarian
PETTO does not provide veterinary, medical or other professional advice, diagnosis or treatment. Nothing in the Service, including pet profiles and summaries, suggested routines, the assistant's answers, health records and what PETTO reads from your documents, care activities and reminders, replaces the advice of a qualified veterinarian.
- Always follow your veterinarian's instructions about your pet's diet, medication, doses and treatment.
- If your pet may be unwell, injured or in danger, contact a veterinarian or an emergency animal service straight away. Don't wait for, or rely on, the Service.
- You remain responsible for the care and wellbeing of your pets.
- A pet's health record, its labels (such as "Up to date" or "Overdue") and the PDF you export are a summary you keep, from what you entered and what was read from your documents. They are not a veterinary certificate or an official record, and may not be accepted as proof of vaccination or treatment, for example for travel, boarding or a new vet. Your vet's own records and certificates are the reference.
4. Who can use PETTO
You must be at least 13 years old, and able to form a binding contract where you live, to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf.
You may not use the Service if the law prohibits you from doing so, or if we have previously ended your account for breaking these Terms.
5. Your account
- Signing in. You can create a PETTO account with your email address, a username and a password, or sign in with your Apple account or your Google account. We use an authentication provider to manage sign-in. If you use email, we send one-time codes to your email address to confirm it and to protect your account, for example when you reset your password. If you use Apple or Google, we never receive your Apple or Google password, and we receive basic details from that account, such as your name, email address and profile picture, as described in our Privacy Policy.
- One person, one account. Your account is for you. Don't share it with anyone or let them use it, and don't transfer it.
- Security. You are responsible for what happens under your account, and for keeping your device, your password and your email account secure (or your Apple or Google account, if you sign in with one). Choose a strong password you don't use anywhere else, and don't share it. Tell us at petto.ai.contact@gmail.com as soon as you can if you think someone has used your account without your permission.
- Apple and Google accounts. Your Apple or Google account is governed by Apple's or Google's own terms, not ours.
6. Plans, PETTO Plus and limits
- Free and PETTO Plus. PETTO has a free plan and a paid subscription, PETTO Plus. The free plan includes 1 pet, 5 messages a day to the assistant, 3 vet documents per pet and 5 documents read a day. PETTO Plus includes up to 5 pets, 25 messages a day, 5 vet documents per pet, 20 documents read a day and the health record as a PDF. Care plans, reminders, care history and health records are part of both plans. The app shows what each plan includes before you buy.
- Price and payment. PETTO Plus is sold monthly or yearly, at the price shown in the app before you buy, in your store's currency (in the United States, currently US$3.99 a month or US$29.99 a year). You buy it through the App Store or Google Play: payment is charged to your Apple or Google account when you confirm the purchase, under the store's terms. We never receive your card details, and we will never charge you without your express agreement.
- Automatic renewal. Your subscription renews automatically for the same period, at the then-current price, unless you turn renewal off at least 24 hours before the current period ends. Your Apple or Google account is charged for the renewal within the 24 hours before the period ends.
- Free trial. Where the app offers it, the yearly plan starts with a 7-day free trial, once per person. Unless you cancel at least 24 hours before the trial ends, it becomes a paid yearly subscription and you are charged when it ends. If you buy a subscription during a trial, the rest of the trial ends.
- Cancelling. You cancel in your App Store or Google Play account settings (in the app: Account, then Manage subscription). Cancelling turns renewal off: you keep PETTO Plus until the end of the period you've paid for, or of the free trial, and the rest of a period isn't refunded, unless Apple or Google decide otherwise or the law requires it. Deleting the app or your PETTO account doesn't cancel your subscription.
- Refunds. Because Apple or Google take the payment, refunds are requested from them and handled under their policies (for Apple, at reportaproblem.apple.com). If a refund is granted, PETTO Plus ends at once. Nothing in these Terms limits rights you have as a consumer.
- When PETTO Plus ends. You go back to the free plan and keep everything you've added: all your pets, their care plans, reminders, history, health records and documents. Until you subscribe again, you can't add pets or documents beyond the free plan's limits, and the assistant, document reading and the PDF follow the free plan. You can always delete anything.
- Price changes. We may change the price of PETTO Plus. A new price applies from a renewal you've been told about in advance, by us or by the store, and you can cancel before then. Where the store requires your agreement to a higher price, your subscription renews at the new price only if you agree.
- Restoring purchases. If you change phones or reinstall PETTO, use Restore purchases (in Account or on the PETTO Plus screen) to get your subscription back. A subscription belongs to the PETTO account that bought it.
- Other limits. To keep the Service reliable, we also set limits on how it can be used: vet documents are photos or PDF files of up to 10 MB each, and PDFs of up to 20 pages; photos are made smaller on your phone, and one still over 8 MB can't be uploaded; and descriptions, messages, notes and other fields have the maximum lengths shown in the app. We may change these limits, and those of each plan, over time. If we lower a limit in a way that affects information you've already added, or reduce what PETTO Plus includes during a period you've paid for, we will tell you before the change takes effect.
7. Your content
"Your Content" is the information you add to the Service: your pets' profiles and details, the descriptions and notes you write or dictate, your photos, your pets' health records and the vet documents you upload, your messages to the assistant, your care activities and their history, and anything you send us in an issue report, including screenshots.
- You own Your Content. These Terms don't transfer ownership of it to us.
- Permission you give us. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, adapt (for example, resize a photo) and display Your Content, only as needed to provide the Service to you, help you when you ask, keep the Service secure and comply with the law. This includes sharing Your Content with the service providers who run parts of the Service for us (Section 10). The licence ends when Your Content is deleted from the Service, except for copies we may keep as described in Section 13 and in our Privacy Policy.
- Your responsibility. You must have the right to share everything you add, including photos and vet documents, and Your Content must not be unlawful or infringe anyone else's rights. Upload only documents about your own pets. You're responsible for keeping your pets' health records accurate. PETTO is about your pets, so please don't put sensitive information about yourself or other people in descriptions, notes, messages or photos.
- Feedback. If you send us ideas, suggestions or reports (for example, through "Report App Issue" in the app), we may use them to improve PETTO without any obligation to you.
8. AI features
- What they do. When you describe your pet in your own words, PETTO sends your description to our AI provider, which pulls out profile details (such as species, breed, age and diet) and writes a short summary. When you add a pet, PETTO also sends your pet's details, plus your description or your answers about its routine if you gave them, to the AI provider to suggest a starting care routine. If you add a photo while describing your pet, the AI describes the pet it sees. If you speak, your phone turns your words into text first, and the AI tidies that text into a description.
- Reading vet documents. When you add a pet with vet documents, or add documents to a pet later, PETTO sends them to our AI provider, which reads the health information and profile details in them. PETTO shows you what it read, flags what it's unsure of, and saves only what you keep after reviewing it. If a document contradicts your pet's profile, PETTO shows you both and changes the profile only if you choose. If a detail your pet's summary is based on changes this way, the AI may write the summary again.
- The assistant. The assistant answers questions about one of your pets, using its profile, health record, care schedule and history, and any photos you send. It only helps with pets and their care. When it suggests care activities or health record entries, they're added to your pet's care or health record only if you choose to add them. If you ask, it can also prepare your pet's health record as a PDF.
- Suggested routines can start right away. If you add a pet by describing it, or answer the routine questions while adding it, the suggested activities are added to your pet's care plan straight away, with reminders on. Please review them, and change or delete anything that isn't right for your pet. You can edit any activity at any time.
- AI can be wrong. AI output is generated automatically. It can be inaccurate, incomplete or not right for your pet. For example, it can misread a detail, a photo or a date on a document, pick times you didn't intend or suggest an activity your pet doesn't need. Check each date read from a document against the original before you rely on it. We instruct our AI provider's model not to invent medical details, but we can't guarantee the result. AI output is not veterinary advice (Section 3). Never rely on it for medication, doses or treatment timing: use your veterinarian's instructions.
- Fair use of AI features. Use the AI features, including the assistant, only to describe and care for your pets. Don't try to make them produce content that is harmful, unlawful or unrelated to your pet's care. When you use them, you also agree to follow the usage policy of our AI provider, Anthropic.
- AI output is yours to use. Profile details, summaries, assistant replies, and the activities and health record entries the AI adds to your pet's profile are treated as Your Content.
9. Reminders
- How they work. Our servers send reminders through a push notification service, which passes them to Apple's or Google's notification systems for delivery to your device. Your phone also schedules the reminders for the next 48 hours itself, so they can ring without a connection.
- Snoozing. A reminder at an activity's time has Snooze buttons. Snoozing moves the activity to its new time: your phone rings the reminder again by itself, even without a connection, and PETTO updates the activity once you're back online.
- They can fail. Reminders depend on things outside our control: your notification permissions and device settings (including Focus, Do Not Disturb and battery-saving modes), your internet connection, your device, and Apple's, Google's and other providers' services. Force-stopping the app or some battery savers can cancel the reminders your phone scheduled until you open PETTO again, and on Android, without the Alarms & reminders permission, a reminder can ring a few minutes late. A reminder can be late, or may not arrive at all.
- Reminders from health records. When a health record entry has a date ahead (a vaccination or its next dose, a vet visit or its follow-up, a surgery, or a course of medicine), PETTO adds a reminder for it to your pet's care, and moves or removes it when you change or clear the date. A reminder is only as accurate as the date in your pet's health record.
- Don't rely on them alone. Reminders are a convenience, not a guarantee. For time-sensitive care, especially medication and appointments, don't rely on PETTO as your only way of remembering.
- Time zones. Activities are scheduled in the time zone recorded when you set them up and don't adjust automatically when you travel. Check your pet's schedule if you change time zone.
- Your control. You can turn reminders off for any activity in the app, or for PETTO entirely in your device settings. Signing out of PETTO on a device normally stops reminders to that device and cancels the ones it scheduled itself.
- Widgets. PETTO's widgets show what the app last saved on your phone, for up to 48 hours ahead, and then ask you to open PETTO; until you do, they may be out of date. An activity you tick on a widget reaches PETTO, and your other devices, the next time the app runs, so a reminder for it may still arrive from our servers before then. Anyone who can see your screen can see what a widget shows.
10. Other companies' services
The Service relies on other companies:
- Apple and Google provide sign-in, distribute the app through the App Store and Google Play, and deliver notifications. Your use of your Apple or Google account, and of their app stores, is governed by their terms.
- Service providers run parts of the Service on our behalf: account sign-in, data storage, background processing, photo storage and delivery, notification delivery, AI processing, and error reporting and diagnostics. Our Privacy Policy lists them and explains what information they receive.
We are not responsible for services we don't control, and their availability can affect the Service.
11. Rules for using PETTO
When using the Service, you agree not to:
- use it for anything unlawful, or for anything other than the personal, non-commercial care of your pets;
- add content you don't have the right to share, or content that is unlawful or infringes anyone's rights;
- access the Service other than through the PETTO app, or use bots, scripts or other automated means to access our servers or AI features;
- try to get around limits we set, or to access information or accounts that aren't yours;
- interfere with or disrupt the Service, test or probe its security without our written permission, or introduce viruses or other harmful code;
- copy, modify, reverse engineer or decompile the app, except where the law or an open-source licence that applies to part of the app allows it;
- misuse the AI features (Section 8), or send spam or abusive reports through "Report App Issue"; or
- give false information about yourself or pretend to be someone else.
12. Our intellectual property
- The Service, including the app, its design, the PETTO name and logo, its illustrations and pet avatars, and its text, belongs to us or our licensors and is protected by intellectual-property laws. Apart from Your Content, these Terms don't give you any rights in it other than the licence below.
- We give you a personal, limited, non-exclusive, non-transferable and revocable licence to download and use the PETTO app on devices you own or control, for your personal, non-commercial use, in line with these Terms and the rules of the app store you got it from.
- The app includes open-source software components, each licensed under its own terms. Nothing in these Terms limits your rights under those licences.
- Please don't use the PETTO name or logo without our permission.
13. Deleting your account, and ending the Service
- You can leave at any time. You can stop using the Service whenever you like. To delete your account, go to Account, then Delete account, in the app.
- What deletion removes. Deleting your account deletes your sign-in account and, with it, your account record and your pets' data in our database: profiles, care plans, care history, suggestions, health records and vet documents, assistant conversations, notifications and device registrations. Deletion is permanent and can't be undone. Some information may remain for a limited time in backups, logs and our service providers' systems, and photo files kept by our photo-storage provider aren't yet deleted automatically, as described in our Privacy Policy. Deleting your account doesn't cancel a PETTO Plus subscription: cancel it in your App Store or Google Play settings, preferably before you delete your account.
- Deleting a pet removes its profile, care plans, care history, health record, vet documents and assistant conversation.
- When we may suspend or end your access. We may suspend or end your access to the Service, or delete your account, if you seriously or repeatedly break these Terms, if we must do so to comply with the law, or if your use creates a risk of harm to others, to the Service or to us. Where appropriate and allowed by law, we will tell you why and give you a chance to fix the problem first.
- If we stop offering PETTO. We may stop offering the Service. If we do, we will give you at least 30 days' notice in the app where reasonably possible, and stop PETTO Plus from renewing.
- What continues after the end. Sections 3, 7 (Feedback), 8 (AI can be wrong), 9 (They can fail), 12, 15, 16, 17 and 20 continue to apply after your account ends.
14. Changes to PETTO and to these Terms
- The Service. We are actively developing PETTO, and we may add, change or remove features and limits.
- These Terms. We may update these Terms from time to time. If a change materially affects you, we will tell you in the app or by email to the address on your account at least 30 days before it takes effect. Changes needed for legal reasons, or that only concern new features, may take effect sooner. The "Last updated" date shows the current version. If you don't agree with a change, stop using the Service and delete your account before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
15. No warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. In particular, we do not promise that:
- reminders will be delivered on time, or at all;
- AI output will be accurate, complete or right for your pet; or
- the Service will be uninterrupted, error-free or secure, or that your information will never be lost.
Some places don't allow these exclusions. Nothing in these Terms limits rights you have as a consumer that the law doesn't allow to be waived.
16. Limits on our liability
To the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue or goodwill;
- we are not liable for losses arising from a late or missed reminder, from AI output, or from your reliance on the Service instead of the advice of a veterinarian; and
- our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim and (b) USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
17. Governing law and disputes
- Talk to us first. If you have a problem with the Service, please contact us at petto.ai.contact@gmail.com. Most issues can be resolved quickly. We will both try in good faith to resolve a dispute informally for 30 days before going to court.
- Governing law. These Terms are governed by the laws of Morocco, without regard to its conflict-of-law rules.
- Courts. The competent courts of Morocco have jurisdiction over disputes about these Terms or the Service.
- Your rights as a consumer. If you use the Service as a consumer, you keep any protection the mandatory laws of your country of residence give you, and, where those laws allow, you may bring a claim in the courts where you live.
18. App store terms
Apple. If you downloaded PETTO from Apple's App Store:
- these Terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the price you paid for it (if any); to the extent permitted by law, Apple has no other warranty obligation for the app;
- we, not Apple, are responsible for any claims relating to the app or your use of it, including product-liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer-protection claims;
- if anyone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for dealing with that claim;
- you confirm that you are not located in a country subject to a U.S. government embargo or designated as "terrorist supporting", and that you are not on any U.S. government list of prohibited or restricted parties;
- you must also comply with any third-party terms that apply when you use the app (for example, your mobile carrier's); and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google. If you downloaded PETTO from Google Play, your use is also subject to Google Play's terms.
19. Languages
These Terms are available in English, French and Arabic. If the versions differ, the English version applies, except where the law of your country requires otherwise.
20. General
- Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a right, that doesn't mean we've given it up.
- Transfer. You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition or sale of the Service, as long as your rights under these Terms are not reduced; we will tell you if this happens.
- Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, including failures of internet, notification or cloud services.
- Third-party beneficiaries. Apart from Apple (Section 18), no one else has rights under these Terms.
